A.   General information on data privacy protection

1.       Validity and definitions

The data protection declaration includes information as set out in Article 13 DSGVO on data processing with context to visiting and using our website “scout4skills.com”. Insofar as visiting third-party sites, we have neither influence nor control over the linked content and the data protection provisions thereof. We recommend that you check the data protection statements on the linked websites to determine whether and to what extent personal data is collected, processed, used, or made accessible to third parties thereof.

2.       Responsibility

Responsible person/s for processing personal data via the website are Scout4Skills GmbH, Alte Land Street 21a, 85521 Ottobrunn, e-mail: info@scout4skills.com (hereinafter: “Scout4Skills”). You can reach our data protection officer by e-mail at ph@hwdata.de.

3.       Place of data processing

All personal data that we collect and process via the website is stored on local servers of the company webgo GmbH in Germany. The purpose of this data processing is the hosting of our web servers and databases as well as their data protection (backup) based on corresponding (order processing) contracts. 

B.   General data processing when visiting our websites

1.      Logfiles

For technical purposes, Scout4Skills collects so-called access data when the website is called up and stores this in a log file (so called ‘log file’). When using this general data and information, we do not draw any conclusions about you as an individual. This information is required to correctly deliver the content of our website, optimising your content for our website and the advertising of it, and to ensure the long-term functionality of our IT systems and the technology of our website, as well as providing law enforcement authorities with the information necessary for prosecution in the event of a cyber-attack. Therefore, the data and information collected will be used by us for statistical purposes only and for the purpose of increasing the data protection and data security of our enterprise to ensure an optimal level of protection for the personal data we process (Article 6 (1) (f) of the Data Protection Regulation).

In addition to the IP address, the name of the website you accessed, the file accessed, the date and time of access, the amount of data transferred and notification of successful access, the browser type and provider are stored in the log file. We do not pass this data on to third parties.

2.       Cookies

In addition to log files, so-called cookies are used when visiting our websites. Details on the cookies used when using our website, their storage duration and information on how you can delete the data collected here can be found in the data protection settings. We distinguish between the following types of cookies:

Necessary/essential cookies: these cookies are necessary to provide the basic functions of the website. They cannot be deactivated in your systems (Art. 6 para. 1 lit. f) DSGVO).

Functional cookies: Functional cookies support the execution of certain functions, e.g., sharing the content of the website on social media platforms, collecting feedback and other third-party functions (External Media). We require your prior consent for the use of these cookies (Art. 6 para. 1 lit. a) DSGVO).

Statistics cookies: These cookies enable us, among other things, to evaluate the calls and visits to the website to improve our website. These cookies are used to make conclusions about the number of visitors, bounce rate and origin of visitors (Art. 6 para. 1 lit. a) DSGVO).

3.      Analysing and tracking tools

We use tracking tools, among other things, to enable  to optimize our offers and presentations by means of usage analysis or to gain insights into our target groups. However, in order to be able to implement and use these tools (or its functions), we need your prior consent (Art. 6 para. 1 lit. a) DSGVO). You can find an overview of the tools as well as their providers in the privacy settings.

4.       Plugins – External Media

Plugins are used on our websites, with which interaction with other services or websites (plugin providers) is usually established. However, we also require your prior consent for this (Art. 6 para. 1 lit. a) DSGVO).  Only then does your browser establish a connection to the servers of the respective network. You can find an overview of the plugins and their providers in the
Privacy settings.

Please note that Scout4Skills is only responsible for the collection of the IP address via the use of the plugin. With regard to the subsequent processing by the providers, they are responsible under data protection law, including the duration of data storage. In addition to the IP address collected by us, the plug-in provider may use your own personal data (held by the provider) for the purposes of advertising (also for third parties), market research and/or demand-oriented design of its own website and to inform other users of the respective network about your activities on our website. The providers also act here as the responsible party in the sense of data protection, as we have no knowledge of the extent to which the provider uses the data obtained from the time you clicked on the respective button. Further information on the purpose and scope of data processing by the plug-in providers as well as information on exercising your rights in this regard (e.g. information and objection) can be found in the data protection statements linked below.

5.       Cookie Management Tool

To manage the cookies and to obtain your consent to store certain cookies on your terminal device or to use certain technologies and to document them in accordance with data protection (Art. 6 para. 1 lit. C DSGVO), we use a so-called cookie management tool. The provider of this tool is Borlabs – Benjamin A. Bornschein, Rübenkamp 32, 22305 Hamburg (hereinafter: “Borlabs”).

6.       Google Tag Manager

On this website we use the Google Tag Manager service. The operating company of Google Tag Manager is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Ireland Limited is part of the Google group of companies headquartered at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Through this tool, “web page tags” (i.e. keywords which are included in HTML elements) can be implemented and managed through an interface. By using the Google Tag Manager, we can automatically track which button, link or personalized image you have actively clicked on and can then record which contents of our website are of particular interest to you. The tool also ensures the triggering of other tags, which in turn may collect data. Google Tag Manager does not access this data. If you have deactivated at the domain or cookie level, this remains in place for all tracking tags implemented with Google Tag Manager. These processing operations are carried out exclusively upon the granting of explicit consent pursuant to Art. 6 para. 1 lit. a) GDPR. C.    Special data processing in the context of the application procedure

1.       Application to Scout4Skills

If you apply to Scout4Skills for an internal position with us, we process the data solely for the purpose of conducting the application process and assessing your professional suitability for the position applied for (Art. 6 para. 1 lit. b) DS-GVO). We do not disclose your personal data to unauthorized third parties. Internally, too, only the departments and colleagues will have access to your data to the extent that they actually need it to evaluate the application for the specific position. We use a specialized provider for our internal HR and application process, with whom we have concluded the necessary data protection contracts.

All personal data will be stored by us in the event of hiring/employment for the duration of the job. In the event of a rejection, we will also delete your personal data no later than six (6) months after notification of our decision.

We will be happy to provide you with further information upon receipt of your application.

2.       Application for a job with our clients

If you are interested in one of the advertised positions with our clients and companies, your data will also be used here exclusively to carry out the application procedure and to assess your professional suitability for the position applied for (Art. 6 para. 1 lit. b) DS-GVO) processed. In addition, we check whether you fit the position and, if so, forward an exposé we have prepared to our clients. However, this only takes place when we have received the corresponding consent for this (Art. 6 para. 1 lit. a) GDPR). From the moment we have forwarded the application documents to the relevant client and customer for examination and review, the latter is also responsible (in addition to Scout4Skills) for the processing of the personal data. D.    Other special data processing

1.       Contact form

We offer a contact form on our website to answer questions from interested parties and users and to provide information about our services. We process the inquiries and information sent to us in this context only to process your inquiry and to contact you (Art. 6 para. 1 f) DSGVO). We store your data at the longest for the duration of a resulting business relationship with you (Art. 6 para. 1 b) DSGVO). If such a business and contractual relationship does not arise as a result of the request, we will delete your data no later than twelve (12) months after the last contact with you. The right to object to processing beforehand or to request deletion remains unaffected, of course.

2.       Google reCAPTCHA

On our website we use the reCAPTCHA function. The operating company of Google reCAPTCHA is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The reCAPTCHA function is primarily used to distinguish whether an input is made by a natural person or is abused by machine and automated processing. The service also includes the sending of the IP address and possibly other data required by Google for the reCAPTCHA service to Google. These processing operations are carried out exclusively upon the granting of explicit consent pursuant to Art. 6 para. 1 lit. a DS-GVO.Further information on Google reCAPTCHA as well as Google’s privacy policy can be found at: https://www.google.com/intl/de/policies/privacy.

3.       Social media and fan pages

We operate presences on online platforms and social networks in order to interact with potential or existing customers, to exchange information with interested parties and users, or to advertise offers and services. We operate our websites in so-called joint (data protection) responsibility with the providers. Data that you directly share or publish via the online platforms and networks (e.g. via comment and chat functions) are processed by us as the responsible party in order to interact with you in this regard or to exchange information with you. As part of this interaction, we may also receive statistical data from the platform operators on the use of our “channels and fan pages”. This includes, for example, information about interactions, likes, comments, or aggregate information and statistics (e.g., IP address; origin of followers) that help us learn about interactions with our site. The legal basis for data processing in our area of responsibility is Art. 6 para. 1 p. 1 f) GDPR.

However, providers also process data under their own responsibility. We have no influence on data that is processed by the provider under its own responsibility in accordance with its own terms of use and data protection conditions. We would like to point out that when calling up the aforementioned providers, additional data (e.g. your usage and “surfing behavior”) may be collected and possibly transmitted to the provider. Please also note that in the event of interaction via the aforementioned media, data may also be processed outside the area of the European Union. Furthermore, user data is usually processed for market research and advertising purposes. For example, usage profiles can be created from the usage behavior and resulting interests of the users. The usage profiles may in turn be used, for example, to serve advertisements within and outside the platforms that presumably correspond to the users’ interests. You can find more detailed information on this in the data protection information of the respective providers. If we have personal data from you in connection with the use of the online platforms and networks, please direct your concerns to us. If you wish to assert rights against a specific provider beyond this, please contact the provider in question.

4.       Your rights

You have the right to request confirmation from us at any time as to whether we are processing personal data about you and the right to obtain information about this personal data. In addition, you have the right to rectification, deletion and restriction of data processing, as well as the right to object to the processing of personal data at any time, or to withdraw consent to data processing at any time, or to request data transfer. In addition, you have the right to complain to a supervisory authority in the event of data protection violations. All information requests, requests for information, revocations or objections to data processing should be sent by e-mail to info@scout4skills.com.

5.       Notes on the special right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of, inter alia, Art. 6 para. 1 lit. e) or f) DSGVO, to object in accordance with Art. 21 DSGVO. We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing is for the establishment, exercise or defense of legal claims.
